This is the Last Will and Testament
of me Lee Compere Broadwell in County of Gloucester Esquire I give to my dear
wife Amy Pomfret Compere the household goods and furniture plate
linen and china in about or belonging to my House at Broadwell aforesaid
together with the provisions wines and liquors that shall be therein at
the time of my decease to and for her own use and benefit I give to my
said wife the sum of five hundred pounds to be paid to her by my Trustees
and Executors hereinafter named out of the first monies that shall come
to their hands under and by virtue of this will I give to each of
my said Trustees and Executors one hundred guineas I give devise and
bequeath all my messuagesNote 1 lands tenements and hereditamentsNote 2 whether
freehold copyhold or leaseholdNote 3 situate in Great Britain and all my
estate right and interest therein respectively and also all my ready
money securities for money stock upon my farm goods goods chattels
effects not hereinbefore specifically given and all other my real and
personal estate of what nature or kindsoever and whatsoever with
their and any of their rights members and appurtenances unto my
friends Brown Young of Areathing Street in the City of London Merchant
and John Benbow of Lincolns Inn in the County of Middlesex Gent.
their heirs executors administrators and assigns to hold unto and to the
use of them the said Brown Young and John Benbow their heirs
executors administrators and assigns according to the nature equality
of such estates respectively upon the trust and to and for the intents
purposes hereinafter mentioned expressed and declared of ?
the same that is to say upon trust nevertheless that they the said
Brown Young and John Benbow or the survivor of them his executors
administrators or assigns shall and do as soon as conveniently may
be after my decease sell dispose of and convey all and singular my
said real and personal estate either together or as parcels and either
by public auction or by private contract to any person or persons
whomsoever for the most money that can or may be reasonably had
or gotten for the same and I do hereby declare that the receipt and
receipts of the said Brown Young and John Benbow or the survivor
of them his heirs executors administrators or assigns shall be a
complete and absolute discharge and complete and absolute discharges
to any purchase or purchases of the said herditaments and premises
or of any part or parts thereof for his her or their purchase money
or of so much thereof as in such receipt or receipts shall be expresed
to be received and that such purchase or purchases respectively shall
not be afterwards answerable or accountable either at Law or in Equity
or at misapplication or nonapplication of such purchase money or
purchase monies or any part thereof and upon further trust that they my
said Trustees or the survivor of them his heirs executors adm'ers shall
and do with and out of the monies to arise from such sale or sales
[either] with my ready money or monies owing to me when and as the
[debts] shall be collected got in and received pay satisfy and discharge all my
just Debts funeral expences & at charges of present and carrying into execution
the trusts of this my Will and the legacies by me afore given and from and
after payment and satisfaction thereof upon further trust that they my said
Trustees or the survivor of them his heirs executors or administrators shall
and do lay out and invest the residue of the said monies either together or
in parcels in some of the Government stocks or funds or upon real security
or securities together with full power for their or the survivor of them
his heirs executors or administrators as occasion shall require from time
to time to call in now place out or invest the same or any part thereof
in any other government stock or fund or upon any other real security
or securities and upon further trust to pay unto my said wife or otherwise
permit and empower her or her assigns to receive and take the dividends
interest and annual produce to arise and be made from a moiety or half
part of the said trust monies x in the support maintenance and education of

my children Amy Compere Lee Compere Jane Compere Esther Compere
and Robert Compere and any other child or children I may hereafter
have and lay out and invest the residue of such dividends interest and
annual produce in or upon the like trusts or securities to accumulate
with the said principal monies shall become payable as after mentioned
and upon further trust to pay and apply the last mentioned moiety or
half part of the said trust monies and the accruing dividends interest c
produce thereof and all accumulations of the same unto my said children Amy
Lee Jane Esther and Robert and such other child or children I may
hereafter have share and share alike as tenants in common the share
of the said Lee and Robert and such other child or children as may be a
son or sons to be paid to him and them respectively upon their respectively
attaining the age of twenty one years of the said Amy Jane
and Esther and such other child or children as may be a daughter or
daughters to be paid to her or them upon her or their attaining their
respective ages of twenty one years or being married which shall first
happen subject nevertheless to the previous hereinafter contained and in case
any of them shall happen to depart this life before his her or their
share or shares shall become payable leaving issue of his or their
body or bodies lawfully begotten then the share be shared of him her or
them so dying whether original or accruing by survivorship as
hereinafter mentioned shall go and be paid unto and amongst such his
her or their respective issue equally share and share alike but in case
any of my said children shall die before his her or their share or shares
shall become payable leaving no lawful issue then the share or shares
of him her or them so dying shall go and be paid to and amongst the
survivors and survivor of them at such time and times as his her or
their original share or shares shall respectively become payable as
aforesaid And upon further trust that they my said trustees or the
survivor of them his heirs executors or administrators shall and do from
and after the decease of my said wife pay and apply two third parts or
shares of the moiety of the said trust moneys the dividends interest and
annual produce thereof are given to her for her life as aforesaid unto
my said son Lee Compere upon his attaining his age of twenty one
years and do and shall pay and apply the other or remaining third
part of the said last mentioned moiety of the said trust monies unto my
said son Robert Compere upon his attaining his said age of twenty
one years And in case either or both of my said sons shall happen to
depart this life before his share shall become payable leaving issue of his
body lawfully begotten then the share of him so dying whether original or
accruing by survivorship as hereinafter mentioned shall go and be paid to
unto and amongst such his or their respective issue share and share alike
but in case either of my said sons shall die before his share shall become
payable leaving no issue then the share of him so dying shall go and
be paid to the survivor at such time and times as are his original share
shall become payable as aforesaid but in case both my said sons shall
die before they shall attain their respective ages of twenty one years
leaving no lawful issue of their respective body and bodies then upon
trust to pay and apply the whole of the said half part of the said moiety
of the said trust monies unto and amongst my said daughters Amy Jane
and Esther share and share alike as tenants in common when and do they
shall severally attain their respective ages of twenty one years or be
married which shall first happen and in case of or either of them
shall happen to die before her or their respective share shall become
payable then the share or shares of her or them so dying shall go and
be paid to the survivors or survivor when and as she or they shall
severally attain her or their age or ages of twenty one years or be
married and upon further trust that they my said trustees or the
survivor of tem his heirs executors or administrators shall and do
from and after the decease of my said wife pay and apply the other
half part of the moiety of the aforesaid trust monies the dividends interest
and annual produce whereof are given to her for her life as aforesaid
unto my said three daughters Amy Jane and Esther share and share
alike as tenants in common when and as they shall severally attain
their respective ages of twenty one years or be married which shall
first happen and in case any or either or them shall happen to die
before her or their share or shares shall become payable then the
share or shares of her or them so dying shall go and be paid to the
survivors or survivor when and as she or they shall attain her or
their age or ages of twenty one years or be married but in case all my
said daughters shall happen to die before they shall attain the
age of twenty one years or be married then upon trust to pay and
apply the last mentioned half part of the moiety of the said trust
monies unto my said son Lee Compere upon his attaining his age of
twenty one years and in case my said son shall die before he shall
attain the said age leaving issue lawfully begotten then upon trust to
pay and apply the same to and amongst such issue equally share and
share and share alike provided always nevertheless and it is my
will that in case I should have any child or children living at my
decease besides the said Amy Lee Jane Esther and Robert or which shall
be born in due time afterwards then I do hereby direct that such child or
children shall be willed equally with the said Amy Lee Jane Esther c
Robert to the said first mentioned moiety of the said trust monies from and after
the death of my said wife and to the whole or such part or parts of the
second mentioned moiety thereof as is or are hereinbefore provided for
then the said Amy Jane and Esther in the event of the death of my said
two sons Lee and Robert without issue as aforesaid and to the interest
dividends annual produce thereof respectively and I do hereby direct that
my said Trustees or the survivor of them his heirs executors or adm'ors
shall pay and apply the whole of the aforesaid trust monies and the
dividends interest and produce thereof and all accumulations of the same
unto the said Amy Lee Jane Esther and Robert and all other my child or
children living at my death or born in due time afterwards accordingly as
tenants in common the share or shares of such of them as shall be a son
or sons to be paid at the age of twenty one and if such son or sons shall die
under that age leaving lawful issue then the share or shares of him or them
as dying shall go to such his or their issue and be divided equally amongst them
and of such of them as shall be a daughter or daughters at the age of twenty
one or marriage it being my intention in case I should leave any other
child or children living at my decease besides the said Amy Lee Jane Esther
and Robert or which should be born in due time afterwards that the whole of
the aforesaid trust monies should be divided amongst all my children with the
like benefit of survivorship between or amongst them and with the allowance
for maintenance and education during that respective minority as is herein
below directed respecting the said Amy Lee Jane Esther and Robert any
trust herein contained to the contrary notwithstanding and in case all my
children shall die before the said trust monies shall become vested interests or
a vested interest in them or some or out of them or in ther or in some or
out of ther issue than upon further trust that they my said trustees or the
survivor of them his heirs executors and administrators shall and do pay and apply
the said trust monies and the accruing dividends interest and produce thereat
unto my brother and sisters Thomas Compere Mary Bosworth and Elizabeth
[left blank] equally amongst them share and share alike but in case any of
my said brother and sisters shall be then dead leaving no lawful issue then
the share or shares of him her or them so dying shall go to the survivors [or]
survivor of them but in case any of them shall then dead leaving issue
such issue shall be intitled to the share which would have belonged to his her
or their deceased parent or parents if living equally as tenants in common
provided always and it is my will that it shall be lawful for my said trustees
or the survivor of them his heirs executors or administrators to apply any
part of the aforesaid trust in and belonging to any of my children or their
issue under this my will or the dividends interest and produce thereof during
their respective minorities in placing him her or their clerk or apprentice
at any profession or trade or to learn any Science or art or in any other
manner for his her or their benefit and that the said trustees their heirs
executors and administrators shall not be responsible for any more or other
of the aforesaid trust estates monies and effects or the rents dividends interest
or produce thereof that they shall severally actually receive nor the one for
the other not for the acts receipts or defaults of the other of them but each for
his own acts receipts and defaults only nor for any loss that my happen by
defect in the title value or sufficiency of any fund estate or security in or upon which
any of the said trust monies shall or may be vested or secured or by the failure
of any Bank Banker or other person with whom the same shall or may be
[lodged] for safe custody nor for any involuntary loss whatsoever and that is
shall and may be lawful for my said trustees their heirs executors or
administrators respectively to deduct and retain out the said trust estates
monies and premises or the rents dividends interest or produce thereof
all costs charges damages and expences which they any or either of
them shall or may pay sustain or be put unto together with a fair
compensation for their time and trouble in and about the execution of the
trusts hereby in them reposed and particularly the said John Benbow
shall be allowed all such fees charges and disbursements as he would be
[entitled] to if employed as Solicitor and not nominated a Trustee I nominate
and appoint the said Brown Young and John Benbow Executors of this
my Will and hereby revoking all former wills by me made and declare this
only to be my last In witness whereof I the said Testator Lee Compere
have to this my will contained in five sheets of paper to the first second
third and fourth sheets thereof subscribed my name and to this fifth and
last sheet subscribed my name and set my seal the ninth day of February
in the year of our Lord one thousand eight hundred and fourteen
